BIG BEN LANGUAGE SCHOOL LTD

I. General Information
1. BIG BEN LANGUAGE SCHOOL LTD, Company number 11242899, hereinafter referred to as the school, with its registered office in the United Kingdom, Unit 4e Enterprise Court, Farfield Park, Rotherham, England, S63 5DB, is a company providing language courses.
2. The school offers language courses, hereinafter referred to as courses, in the form of group and individual sessions, hereinafter referred to as lessons.
3. The school offers courses in the following modes:
– in-class – lessons conducted in classrooms,
– online – lessons conducted through an online platform with live instructor,
– hybrid – lessons conducted in-class as long as sanitary guidelines allow for group sessions. If there are restrictions on the number of people in a room or other circumstances of increased risk, the entire group continues learning online. The decision on the mode of lessons is made by the school management.
4. The school provides suitable teaching staff, educational facilities, and premises necessary for conducting in-class courses.
5. The school ensures appropriate technical facilities, including software and infrastructure, enabling the organization of hybrid and online language courses.
6. Course participants, hereinafter referred to as students, are responsible for ensuring the technical conditions necessary for participating in online lessons.

II. Conditions for providing electronic services

1. To properly use the website and other services offered by the service provider, the following technical conditions must be met:
a. access to the Internet;
b. internet browser capable of using the booking panel;
c. active email account.
2. The service provider does not guarantee uninterrupted and error-free access to the website. Particularly, access may be limited due to necessary repairs, maintenance, and new solutions.
3. The recipient of the service is prohibited from providing unlawful content, especially content:
a. defaming the reputation of third parties;
b. breaching the trade secrets of third parties;
c. infringing the intellectual property rights of third parties;
d. constituting unfair competition;
e. encouraging any unlawful activities.

III. Course participation conditions
1. Acceptance of the school’s terms and conditions and the GDPR clause in the enrollment form is a requirement for participating in the course.

IV. Lesson organization
1. Students are assigned to lesson groups according to their language skills. The allocation of a new student to a group is based on the result of a qualification test organized by the school. Continuing students are assigned to groups based on their final exam results.
2. The maximum number of course participants is provided by the school during registration.
– If the number of course participants falls below 70% of this value, the school has the right, in agreement with the students, to reduce the number of lessons, establish additional fees, or dissolve the group and refund the participants for unconducted lessons.
– The school allows learning in smaller groups than specified by the school upon individual cost calculation.
3. Lessons are not held during holidays, school breaks, and public holidays.
4. Details regarding courses, language proficiency tests, group levels, lesson frequency, and quantity per semester are provided by the school during recruitment.

V. Payments
1. The course price is provided by the school during enrollment.
2. The course price includes:
– placement test;
– a specific package of lessons determined during registration;
– diagnostic tests conducted during the school year;
– additional materials for students;
– semester and final exams;
– course completion certificate.
3. The student or legal guardian pays the course fee:

3.2 through the external payment system Tpay, managed by the company Krajowy Integrator Płatności S.A. (National Payment Integrator Joint-stock company) with its headquarters in Poznań, Andersa Square 3, 17th floor, 61-894 Poznań.

4. The student or legal guardian agrees to pay the semester fee in full before the semester starts (with a 5% discount) or to settle this fee in five installments during the semester. Payment details will be provided by the school during registration.
5. The first payment confirms course participation and serves as the basis for issuing a VAT invoice. Subsequent invoices will be issued based on payments made by the student/guardian according to the established schedule.
6. Failure to make payment on time is a basis for considering the student’s intent to withdraw from the course, equivalent to exempting the school from the obligation to continue providing services to the student, and removal from the list of course participants.
7. Invoices will be sent by the school via email to the address provided by the student or guardian.

VI. Course Withdrawal
1. The student has a 7-day trial period during which they can withdraw from the course and receive a full refund upon written or verbal notice.
2. After the trial period, both parties have a 14-day withdrawal period starting from the date of written or verbal notice submission. Submitting written or verbal withdrawal to the school’s administration is a condition for terminating mutual obligations and the basis for mutual settlement:
– In case of overpayment by the student/guardian, the refund amount includes the value of unused lesson units calculated after the withdrawal period.
– In case of underpayment, the student/guardian is obliged to pay the remaining tuition fee for the due learning period.
3. The school reserves the right to cancel a course due to an insufficient number of interested participants. In such a case, the school will refund the full amount paid.
4. The school reserves the right to remove a student from the list of participants and terminate the agreement without observing the withdrawal period if their behavior violates lesson conduct or poses a threat or discomfort to other course participants. In such a situation, the school will provide financial settlement details.

Complaint Policy
1. The student/guardian has the right to file a complaint if dissatisfied with the quality of teaching services.
2. The complaint should include:
– student’s name, email address, and contact phone number;
– detailed description of the complained service along with reasoning.
3. The complaint should be submitted in writing to the email address: office@ibigben.com.
4. The school will respond to the complaint within 14 days and inform the complainant via postal mail or email about the steps taken.

VIII. Privacy Policy

2. During enrollment, the student/guardian electronically accepts or rejects the following consents:
– consent for the school to process personal data for purposes related to course organization and conduct, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR);
– consent to post photos of the student on the school’s website;
– consent to process personal data in the form of an email address for marketing purposes, including sending information about other events organized by the school.
